2. Scope and Acceptance

These Terms & Conditions govern all purchases made through the website https://78glass.tips. By placing an order, you confirm that you have read, understood, and accepted these terms in full.

These terms apply to consumers and users as defined by Spanish law (Real Decreto Legislativo 1/2007). If you are purchasing as a business or for commercial purposes, please contact us directly.

3. Age Requirement and Product Use

Age requirement. You must be at least 18 years of age to make a purchase from this store. By placing an order, you confirm that you meet this age requirement. We reserve the right to cancel and refund any order where we have reasonable grounds to believe the purchaser is under 18.

Nature of the products. Our products are handcrafted, reusable borosilicate-glass smoking accessories (mouthpieces for rolled products). They are sold as durable, reusable alternatives to single-use paper or plastic tips.

Intended use and purchaser responsibility. The products are intended for lawful personal use only, in accordance with the laws of the jurisdiction in which the purchaser uses them. The purchaser is solely responsible for compliance with all applicable national and local laws regarding the substances, if any, used with the products. The products are not sold for use with any substance whose possession, sale, or consumption is prohibited in the purchaser's jurisdiction.

No tobacco, no controlled substances. We do not sell tobacco, nicotine products, cannabis, or any other regulated or controlled substance. We sell only the glass accessory itself.

4. Products

All products sold through this store are handmade borosilicate glass items. Due to the handcrafted nature of our products, minor variations in colour, shape, or dimensions may occur between pieces. These variations are inherent to the craft and do not constitute a defect.

Product images are provided for illustrative purposes and may not perfectly represent the exact item you receive, particularly for items described as unique or one-of-a-kind (such as Drop releases).

5. Formation of Contract

The display of products on our website is an invitation to make an offer and does not constitute a binding offer by the seller.

When you place an order by clicking the "Pay" button, you submit a binding offer to purchase the items in your cart and confirm an obligation to pay. Payment is captured immediately through Stripe.

The purchase contract is formed at the moment payment is successfully authorised and captured. You will receive an order confirmation email, which also serves as confirmation of the concluded contract.

We reserve the right to cancel the order within 5 business days if:

  • an item is out of stock;
  • there is a manifest pricing error;
  • we cannot lawfully ship to the purchaser's jurisdiction;
  • we have reasonable grounds to believe the purchaser does not meet the age requirement (§ 3) or is violating these terms.

In such cases, we will refund the full amount paid through the original payment method.

6. Prices

All prices displayed on the website are in EUR and include VAT where applicable. The total price, including shipping costs, will be clearly displayed before you confirm your order.

We reserve the right to modify prices at any time. However, any price changes will not affect orders that have already been confirmed.

7. Payment

Payments are processed securely through Stripe. The following payment methods are accepted:

  • Credit and debit cards (Visa, Mastercard, and others supported by Stripe)
  • Other methods available through Stripe at checkout

Payment is charged at the time of order placement. All transactions are encrypted and processed in accordance with PCI DSS standards. We do not store your card details on our servers.

9. Right of Withdrawal and Returns

10. Legal Guarantee of Conformity

In accordance with Articles 114–127 of the Spanish Real Decreto Legislativo 1/2007 (TRLGDCU), as amended by Ley 7/2022, and EU Directive 2019/771, all products sold to consumers come with a legal guarantee of conformity of 3 years from the date of delivery.

If a product is found to be non-conforming, you may request repair or replacement at no cost. If repair or replacement is impossible or disproportionate, you are entitled to a proportional price reduction or to rescind the contract and receive a full refund.

For defects appearing during the first 2 years after delivery, the product is presumed to have been non-conforming at the time of delivery (Art. 121 TRLGDCU). After those 2 years, the burden of proof shifts to the consumer.

11. Intellectual Property

All content on this website — including but not limited to photographs, product images, text, logos, graphic designs, and the brand name "78GlassTips" — is the property of the seller or is used with the permission of the rights holder.

Reproduction, distribution, public communication, or transformation of any such content without express written authorisation is prohibited and may constitute an infringement of intellectual property rights under Spanish law (Real Decreto Legislativo 1/1996, Ley de Propiedad Intelectual).

12. Limitation of Liability

To the maximum extent permitted by applicable law:

  • We shall not be liable for indirect, incidental, or consequential damages arising from the use of our products or website.
  • Our total liability for any claim related to a product shall not exceed the purchase price of that product.
  • We are not liable for damages arising from improper use or handling of glass products.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

13. Data Protection

Your personal data is processed in accordance with our Privacy Policy, the General Data Protection Regulation (EU) 2016/679 (GDPR), and the Spanish Ley Orgánica 3/2018 de Protección de Datos Personales y Garantía de los Derechos Digitales (LOPDGDD).

14. Online Dispute Resolution

In accordance with Regulation (EU) No 524/2013, the European Commission provides an Online Dispute Resolution (ODR) platform, which is available at:

15. Applicable Law and Jurisdiction

These terms are governed by and construed in accordance with the laws of Spain, without regard to conflict of law provisions.

If you are a consumer residing in the European Union, you shall also benefit from any mandatory provisions of the consumer protection law in your country of residence. Nothing in these terms affects your rights as a consumer under such provisions.

For any disputes arising from these terms, the courts of the consumer's place of residence shall have jurisdiction, in accordance with applicable EU consumer protection regulations.

16. Severability

If any provision of these terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. Modifications

We reserve the right to modify these Terms & Conditions at any time. Changes will be published on this page with an updated "Last updated" date. Continued use of the website after such changes constitutes acceptance of the new terms. Changes will not apply retroactively to orders already placed.
